Although the UDHR Universal Declaration of human Rights is a non- binding resolution, it is now considered to be a central component of international customary law which may be invoked under appropriate circumstances by national and other judiciaries.

The UDHR urges member nations to promote a number of human, civil, economic and social rights, asserting these rights are part of the "foundation of freedom, justice and peace in the world. The members of the Commission did not immediately agree on the form of such a bill of rights, and whether, or how, it should be enforced. Canadian law professor John Humprey and French lawyer Rene Cassin were responsible for much of the cross-national research and the structure of the document respectively, where the articles of the declaration were interpretative of the general principle of the preamble.

The document was structured by Cassin to include the basic principles of dignity, liberty, equality and brotherhood in the first two articles, followed successively by rights pertaining to individuals; rights of individuals in relation to each other and to groups; spiritual, public and political rights; and economic, social and cultural rights.

The final three articles place, according to Cassin, rights in the context of limits, duties and the social and political order in which they are to be realised. Humphrey and Cassin intended the rights in the UDHR to be legally enforceable through some means, as is reflected in the third clause of the preamble. Some of the UDHR was researched and written by a committee of international experts on human rights, including representatives from all continents and all.

One of the most serious of violations of human rights is the case of racial discrimination. South Africa for example, had for quite some time practised a policy called Apartheid.

As a result the black people who were in majority there had no political rights. The country was ruled by a minority regime of whites. The UN passed resolution to condemn its racist policy. Many countries including India broke their diplomatic relations with South Africa. However, the practice of Apartheid did not last for long. After a long struggle South Africa saw a significant change in this regard. For the first time in its histoiy, the people of South Africa got a Black President, Nelson Mandela, on the basis of one person one vote.

Now, all the people of South Africa enjoy civil and political rights irrespective of race, colour and creed. Human Rights must be ensured to all human beings for their prosperity and happiness. India, being a democratic country, provides such rights to its citizens. The makers of the Indian Constitution have incorporated many of the human rights mentioned above in our constitution.

Today minorities in many parts of the world have no political rights. The story of Ms. Suu Kyi Myanmar is a shining example in this respect. Cruelty to prisoners of war, unjust treatment of prisoners in jail, economic discrimination, casteism, rape, child labour, child prostitution, etc. Protection and maintenance of human rights is a fundamental duty of every government.

Countries, particularly the democratic countries, must stand together in this respect and take necessary persuasive and even coercive actions, to see that these fundamental human rights are adhered to by people, organisations and countries all over the world.
